Terms of Service

Welcome! These Terms of Service ("Terms") govern your use of Wishignite(the "Service"), operated by Lilico LLC, a Delaware limited liability company with its principal place of business in California ("we", "us"). By using the Service, you agree to these Terms.

1. What the Service is

Wishignite is a free tool for organizing gift exchanges and keeping wishlists: create an exchange, invite people with a link, draw names secretly, and share gift ideas year round.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with a parent or guardian's permission.

3. Your account

You can sign in with an email one-time code, or participate as a guest through an invite link. You are responsible for activity that happens through your account or your device's guest session. Keep your invite links private: anyone holding an invite link can join that exchange.

4. Acceptable use

You agree not to:

• use the Service for anything unlawful, deceptive, or harmful
• harass, impersonate, or spam other people, including through exchange invitations
• probe, overload, or interfere with the Service, or bypass rate limits, access controls, or the wishlist capture system
• scrape or bulk-collect content or personal information from the Service
• upload content you do not have the right to share, or content that is abusive, hateful, or sexually explicit

5. Your content

You keep ownership of what you create on the Service, such as exchange names, wishlist items, and notes. You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and process that content solely to operate and improve the Service. You are responsible for the content you add.

6. Gifts and purchases

The Service organizes gift exchanges; it does not sell, buy, ship, or guarantee any gift. Purchases you make through retailer links happen on the retailer's site, under the retailer's terms. Any dispute about a product is between you and the retailer.

7. Affiliate links

Outbound retailer links may include an affiliate tag, and retailers may pay us a commission on purchases made through them, at no extra cost to you. Affiliate relationships never determine what appears on anyone's wishlist. See our Affiliate Disclosure.

8. Our intellectual property

The Service, including its software, design, and content we created, belongs to Lilico LLC and is protected by law. These Terms do not grant you any right to use our names, logos, or branding. All product names and trademarks that appear in wishlist content belong to their respective owners.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LILICO LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO FIFTY US DOLLARS (US$50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold harmless Lilico LLC and its officers, members, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content or your violation of these Terms.

12. Termination

You can stop using the Service at any time, and you can request account deletion as described in the Privacy Policy. We may suspend or terminate access that violates these Terms or harms the Service or its users. Sections that by their nature should survive termination do survive, including 5, and 8 through 13.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in California, and you consent to their jurisdiction. TO THE EXTENT PERMITTED BY LAW, YOU AND LILICO LLC EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

14. Changes to these Terms

We may update these Terms as the Service evolves. If a change is material, we will make that clear on the site. Continuing to use the Service after changes take effect means you accept them.
